Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) form a legally binding agreement between you (“User”, “you”) and TradePilot (“TradePilot”, “we”, “us”) governing your access to and use of the TradePilot website (tradepilot.co.in), web application, and Chrome extension (collectively, the “Service”).

By creating an account or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Service.

You must be at least 18 years of age to use the Service. By using the Service you represent that you meet this requirement.

2. Description of Service

TradePilot is an AI-powered tool that generates TradingView Pine Script code from natural-language prompts. It also provides Pine Script editing assistance, backtest analysis descriptions, and inline code-fixing capabilities through a Chrome extension.

The Service is provided for educational, research, and informational purposes only. TradePilot is not a licensed financial adviser, investment adviser, stockbroker, portfolio manager, or financial planner. Nothing generated by the Service constitutes financial advice, investment advice, trading advice, or any recommendation to buy or sell any financial instrument.

3. Financial and Trading Risk Disclaimer

General Risk

Trading financial instruments — including equities, derivatives, futures, options, foreign exchange, and cryptocurrencies — involves substantial risk of loss and is not suitable for all investors. You may lose some or all of your invested capital. Never trade with funds you cannot afford to lose.

AI-Generated Code is Not Advice

The Pine Script strategies and indicators generated by TradePilot are mathematical models created by an AI system. They are provided as starting points for your own research and testing, not as ready-to-deploy trading systems.

  • AI-generated code may contain errors, logical flaws, or assumptions that are unsuitable for your circumstances.
  • Past backtest performance does not guarantee future results.
  • Backtested results are subject to look-ahead bias, survivorship bias, overfitting, and other well-documented limitations of historical simulation.
  • Leveraged trading can result in losses exceeding your initial deposit.
  • Market conditions can change rapidly and without warning.

India — SEBI Disclaimer

TradePilot is not registered with the Securities and Exchange Board of India (SEBI) as an Investment Adviser, Research Analyst, or Portfolio Manager. The outputs of this Service do not constitute “investment advice” or “research reports” as defined under SEBI (Investment Advisers) Regulations 2013 or SEBI (Research Analysts) Regulations 2014. Indian users should consult a SEBI-registered adviser before making any investment decision.

Hypothetical Performance Disclaimer

HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE INHERENT LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING AND MAY HAVE BEEN PREPARED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN. ACTUAL RESULTS WILL VARY.

You acknowledge and agree that you bear full and sole responsibility for any trading decisions you make using the Service, and that TradePilot has no liability for any resulting profits or losses.

4. Account Registration and Security

  • You must provide accurate and complete information when registering an account.
  • You are solely responsible for maintaining the confidentiality of your credentials and for all activity under your account.
  • You must notify us immediately at itsvishnups@gmail.com if you suspect unauthorised access to your account.
  • You may not share your account or credentials with any other person.
  • One account per person. Creating multiple accounts to circumvent credit limits or restrictions is prohibited and may result in immediate termination of all associated accounts.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

  • Use the Service in violation of any applicable law or regulation, including Indian IT law, RBI guidelines, SEBI regulations, and GDPR.
  • Attempt to reverse-engineer, decompile, scrape, or extract the AI models, proprietary prompts, or system architecture underlying the Service.
  • Abuse, overwhelm, or perform denial-of-service attacks against our infrastructure.
  • Use the Service to generate content intended to mislead, defraud, or harm others.
  • Resell, sublicense, or create derivative commercial products based on TradePilot's outputs without our written consent.
  • Violate TradingView's own Terms of Service when using generated scripts on their platform.
  • Submit prompts containing unlawful, defamatory, or harmful content.

6. Credits and Subscription

The Service operates on a credit-based system. Each AI generation consumes credits proportional to the AI tokens used. Credits reset monthly for active subscriptions. Unused monthly credits do not roll over to the following month.

Subscriptions are billed in advance on a monthly or annual basis via Dodo Payments. All payments are subject to Dodo Payments' terms and conditions. TradePilot does not store your payment card details.

We reserve the right to modify subscription prices, credit allocations, and plan features. We will provide at least 30 days' advance notice by email before any change takes effect for existing subscribers.

7. Refund Policy

We offer a 7-day money-back guarantee for first-time purchases of a paid plan. If you are not satisfied, contact itsvishnups@gmail.com within 7 days of your initial payment and we will issue a full refund — no questions asked.

After the 7-day window, refunds are granted at our sole discretion on a case-by-case basis. Monthly subscription renewals are non-refundable once processed. Credits that have been consumed are non-refundable.

For Indian consumers, this refund policy is in addition to (and does not limit) any rights you may have under the Consumer Protection Act, 2019.

8. Intellectual Property

Generated outputs: Pine Script code generated by TradePilot in response to your prompts is provided to you for your own use. TradePilot claims no ownership over generated code. You are free to use, modify, and deploy generated code subject to TradingView's terms of service.

TradePilot property: The TradePilot brand, logo, website design, underlying software, proprietary prompts, and documentation are the exclusive intellectual property of TradePilot and are protected by applicable copyright, trademark, and other IP laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

Your content: You retain ownership of prompts and any content you input into the Service. By submitting prompts, you grant TradePilot a limited, non-exclusive, royalty-free licence to process your input solely for the purpose of delivering the Service to you. We do not use your personal prompts to train AI models without your explicit consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE;
  • AI-GENERATED CODE WILL BE FREE FROM BUGS, COMPILE ERRORS, OR LOGICAL ERRORS;
  • ANY GENERATED STRATEGY WILL BE PROFITABLE OR SUITABLE FOR YOUR INVESTMENT OBJECTIVES.

You use all generated code at your own risk after independent review and testing.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRADEPILOT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

  • TRADING LOSSES OR FINANCIAL LOSSES OF ANY KIND;
  • INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES;
  • LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITIES;
  • DAMAGES ARISING FROM ERRORS, BUGS, OR INACCURACIES IN AI-GENERATED CODE.

In jurisdictions that do not allow limitation of certain liabilities (including some provisions of the Consumer Protection Act, 2019 for Indian consumers), our liability shall be limited to the maximum extent permitted by law. In any event, our aggregate liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless TradePilot and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any trading decisions made using the Service.

12. Termination

By you: You may terminate your account at any time by contacting itsvishnups@gmail.com. Upon termination, your data will be deleted in accordance with our Privacy Policy.

By us: We reserve the right to suspend or terminate your account immediately, without notice, if you: (a) breach these Terms; (b) engage in fraudulent activity; (c) abuse the credit system; or (d) use the Service to cause harm to others. In non-emergency cases we will provide reasonable notice where required by law.

Sections 3, 8, 9, 10, 11, 13, and 14 survive termination.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

For Indian users: Any dispute arising from or relating to these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with proceedings conducted in English. The seat of arbitration shall be India.

For EEA / UK users: Nothing in these Terms affects your rights as a consumer under applicable EU or UK consumer protection law, including the right to bring a claim in your country of residence. For GDPR-related complaints, you retain the right to lodge a complaint with your national supervisory authority.

Consumer protection (India): These Terms do not limit any rights you have under the Consumer Protection Act, 2019 or any other mandatory consumer protection legislation.

14. Modifications to These Terms

We may update these Terms from time to time. We will notify you of material changes by email and/or by posting a notice on the Service at least 15 days before the changes take effect for existing users. If you continue to use the Service after the effective date, you accept the revised Terms.

If you do not accept a material change, you may terminate your account before the effective date and receive a pro-rata refund of any unused prepaid subscription period.

15. Miscellaneous

  • Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and TradePilot regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.
  • No waiver: Our failure to enforce any right under these Terms shall not constitute a waiver of that right.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.
  • Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, government actions, or internet infrastructure failures.
